Bin lorry driver is convicted of causing death of grandmother he ran overAlan Cole, 58, was convicted of causing the death of grandmother Teresea O'Regan on November 24, 2014A bin lorry driver was convicted of causing the death of a grandmother after he reversed into her while she was walking her dogs.Alan Cole, 58, who had denied causing 72-year-old Teresea O'Regan's death by careless driving, was told by a judge at Gloucester crown court that he will not be jailed.Cole, of Albermarle Gate, Pittville, Cheltenham, was bailed for a pre-sentence report and will return to court on June 23 for sentence.The court heard how Mrs O'Regan was walking her two dogs on her regular morning route along a 250 yard track from the A38 at Norton to the Gloucester Clay Pigeon Shooting club on November 24, 2014.The jury were told that she was probably listening to her personal radio through earphones as Cole arrived to collect the rubbish from the gun club in his 26 tonne Dennis truck.Cole regularly reversed down the narrow track, which is about the same width as his lorry, because there is little room to turn at the clubhouse.pre bonded hairBut he did not ask Arthur Greenwood, who was with him in the cab, to get out and assist him in reversing down the track, the jury heard.Cole told the jury that he was worried he might endanger Mr Greenwood on such a narrow path and in the blind spot of the vehicle so chose not to deploy him.Mother-of-two Mrs O'Regan was oblivious to the truck reversing up behind her with its hazard lights flashing and beepers sounding.Cole previously told the court: 'I didn't see the lady [Mrs O'Regan]. I didn't see any dogs. And then the lorry went bump, bump like I went over a pothole.'Mrs O'Regan was run over by all three of its nearside wheels and died instantly.
After Cole was today convicted of causing her death by careless driving, Mrs O'Regan daughter Sharon Nash said in a statement: 'My mum was clever, wise, kind and funny.'She was not just a wonderful mother to my brother and I but a much loved grandmother and sister.'It is almost impossible to put into words the impact that this devastating accident has had on our lives.'She was fit and well and we had the expectation of many years of happy family life to come - weddings, graduations, significant birthdays, maybe even great-grandchildren.Teresea O'Regan was walking her two dogs on her regular morning route along in Gloucester when the lorry reversed into her'Happy family moments will still happen but she will not be there to share them with us.remy hair extensions'She loved poetry and literature and Radio 4, but most of all she loved her family. She was a mother and grandmother with a sense of fun, the wise counsellor who always had time to listen and share the highs and lows of life.'Her statement continued: 'We, her family, have all struggled emotionally in coming to terms with her death.Life is uncertain and we all expect to lose family members through old age or illness but this horrific accident left us all walking under a black cloud. One moment she was there, walking her beloved dogs and enjoying life, the next she was gone.'We were heartbroken, forever denied the opportunity to express our love for her and ultimately the chance to say goodbye.'It's hard to explain how deeply her loss has affected me and the rest of the family. Her love was unconditional. It filled our hearts and soothed our souls.'Our children will never again receive the special brand of loving from their Grandma. A gaping hole has been left in all our lives.'My mother was a spiritual person with a strong moral compass. She still should be.'During the trial the jury heard that the Health and Safety Executive had investigated as well as the police.It concluded that the tragedy could have been avoided if a proper risk assessment had been made.An inspector said that the position of the clubhouse bins could have been moved to prevent the need for the vehicle to reverse or a smaller lorry could have been sent to the site.When the jury forewoman announced the guilty verdict Cole bowed his head and looked tearful.Judge Michael Harington agreed to bail Cole for a pre-sentence report.She said: 'Despite the ghastly consequences of what happened clearly it was not his fault alone and I can say now that I will not pass an immediate custodial sentence on him.'Cole left the building with a group of family and friends and declined to comment.
